4th Phase Water Technologies Private Limited (the “Company”) believes in the right to privacy of every person. The Company respects and adheres to the requirements for protection of personal information in letter and spirit. The Company deems it is necessary for the users of the websites (the “User(s)”) https://jivawater.in/ or https://jivawater.com/ (the “Website”), which is owned and operated by the Company, to know how the information collected from the Users engaged with the Company through the Website is protected.
Irrespective of the country in which the User resides or accesses the Website from, by accessing the Websites and giving the Company any information, it is deemed that the User authorizes the Company to transfer, store, and use his/her/its information.
1. GENERAL
This Privacy Policy (“Policy”) is an electronic record in terms of Information Technology Act, 2000 and Rules thereunder as applicable and as amended from time to time. This document is published in accordance with the provisions of Rule 4 of the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 (“2011 Rules”) that among other things require publishing of privacy policy of the Website.
2. CONSENT
The User, by using this Website, shall be deemed to have provided his/her/its consent to this Policy and to the collection, transfer, use, storage, disclosure and sharing of his/her/its information as described by the Company in accordance with this Policy.
3. USER DATA
The Company collects personal information from the User in three ways:
- Information the User submits: The Company collect personal information directly from the User when the User visits the Website or creates ‘User Account’ or when the User purchases the products on the Website. The Company collects the following personal information from the User: first name, last name, date of birth, email address, billing and shipping addresses, and mobile number for the statistical and other purposes. More detailed information will be collected at the time of placing order for products sold by the Company. Comments, feedback or reviews provided by the User of the products purchased by the User from the Website will also be considered as information submitted by the User (collectively “User Data”).
- Passive Collection of Unidentifiable Information: The Website automatically collects certain information without the User actively submitting such information. Unidentifiable information may be collected using various technologies, such as cookies, internet tags, and web beacons. Internet browser automatically transmits to the Website some of this unidentifiable information, such as number of times the User visited the Website, the IP address of the device the User is using, URL of the website the User just visited, the browser version device the User is operating etc. The Company uses Google analytics to understand Users’ site usage. - Information Received from Third Parties: If the User visits the Website through third party social networking sites or links on third party social media, personal information such as name, email address and details of the social media profile may be shared with the Company. Also, the Company may receive the User’s personal information when interacting with the Company’s social media handles/pages by following its handles/ pages or reacting to its posts. Any data received from the third party networking site is dependent on the User’s privacy settings in that site.
The Website is hosted on Shopify’s platform and all information submitted on the Website is stored on Shopify’s database. Shopify’s privacy policy can be found at: https://www.shopify.com/legal/privacy.
Users accessing the Website may receive targeted advertisements or marketing communications on Google and Facebook. Users can opt out of such advertising with the help of the below links:

4. LINKS TO THIRD PARTY WEBSITES
The Website may contain links to third party partner websites, advertisers, retailers, and affiliates on which the Products of the Company are listed. If the User leaves the Website and follows any third party website links, the Company is not responsible for any information displayed on or information collected by such third party websites on which the Company’s products are listed.
5. COOKIES
The Website uses "cookies." A cookie is a small text file that is stored on the User’s computer for record-keeping purposes. A cookie does not identify the User personally or contain any other information about the User but it does identify the User’s computer.
The Company and some of its affiliates and third-party service providers may use a combination of “persistent cookies” (cookies that remain on the hard drive for an extended period of time) and “session ID cookies” (cookies that expire when the User close the browser) on the Website to, for example, track overall site usage, and track and report on use and interaction with advertising impressions and advertisement services.

7. USES OF USER DATA
The Company uses the User Data only for following purposes:

- To help with your orders and fulfill shipments (personal information may be shared with third party vendors who will assist in fulfilling shipment of orders).
- To communicate on the payment and order status.
- For internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes.
- To understand the users (what products they like, what offers they like, how they use them, etc.), to improve the content and features of the Website and Products.
- To generate and review reports and data about, and to conduct research on, the User base and products usage patterns.

By using the Website, the User consents to his/her/its User Data being collected, held and used as above and for any other use the User specifically authorises. Collected information will not be sold, exchanged, transferred, or given to any other person by the Company without the express consent from the User, except as required by law under search warrants, court orders and such like.
The Company will comply with all applicable laws for any information stored, collected, processed, or used outside India. The User accepts that privacy and confidentiality obligations may differ from region to region and the legal obligations may be less stringent in some countries when compared to India.
- DATA SECURITY PRECAUTIONS
The Company will safeguard, according to strict standards of security and confidentiality all User Data collected and Company has all security procedures are in place to protect the confidentiality, integrity and availability of User Data. Strict physical, electronic, and administrative safeguards to protect User Data from unauthorized or inappropriate access is maintained by the Company.
The Company follows generally accepted standards to collect, store and protect User Data. All User Data are retained as long as they are needed by the Company to provide services to the User, and thereafter for legal purposes. These may include retention periods which are mandated by legal, contractual, or similar obligations for resolving, preserving, enforcing, or defending the Company’s legal and contractual rights and obligations.
Where the Company have given (or where the User has chosen) a username and password which enables the User to access the Website, the User is responsible for keeping these details confidential. Users are advised not to share their password with anyone.
The User needs to be aware that the transmission of information via the internet is not completely secure. Although the Company will do its best to protect personal information, it cannot guarantee the security of its data transmitted through the Website. Therefore, posting of personal data/ information on this Website constitutes acceptance of this risk by the User.
The Company undertakes to comply within the stipulated time of any new law made by the Government or its authorities with respect to Data Security and Protection in future.
9. OPT-OUT
When the User signs up for an account, he/she/it is opting to receive emails from the Company. User can log in to manage email preferences or can follow the “unsubscribe” instructions in the email messages, but User cannot opt out of receiving certain administrative notices, service notices, or legal notices from the Company.
If User wish to withdraw consent for the use and disclosure of the User Data in the manner provided in this Policy, the User may write to support@jivawater.com. The User’s request shall take effect no later than 5 (five) business days from the receipt of such request, after which the Company will not use User Data for any processing.
10. DO NOT TRACK REQUESTS
No consistent industry practice is currently in place to respond to “do not track” requests. Therefore, if such a request is received from the User’s browser, the Company will not take any measures to alter its data collection or usage practices.
11. CHILDREN’S PRIVACY
The usage of this Website is not directed at User below the age of 18 years (“Child”). Use of the Website by persons below this age must be under parental guidance. The Company does not intentionally collect personal information of Children. If the User becomes aware that personal information about a Child has been provided to us or if personal information has been uploaded by a Child, please immediately contact the Grievance Officer (whose details are provided below) for deletion of such information.
12. POLICY CHANGES
This Policy maybe revised from time to time and such changes to the Policy will be updated on this page. If any significant changes are made to this Policy, the User will be provided reasonable notice of such changes, such as via prominent notice on the Website. To the extent permitted under the applicable law, continued use of the Website after the changes are notified, shall constitute consent of the User to the updated Policy.
This policy is subject to revision and changes as and when there are regulatory changes or when the Company deems fit.

14. JURISDICTION
This Policy shall be governed in accordance with laws of Republic of India and courts at Bengaluru, India shall have exclusive jurisdiction.
